Accidents happen every day. The majority are minor but there are some that can have the most profound consequences.
Some may be your fault, in whole or in part.
There is no doubt that the law is very complex but the general principles are really just common sense. The majority of people generally can tell if an accident was their own or someone else’s fault. They can even tell if they were partially to blame, e.g. you were injured by a car in circumstances where you were not really paying attention but the car that hit you was speeding. It may have been partially your fault but the major fault lies with the car driver. The way in which the Courts deal with this is firstly to assess the damages. They then asses blame so that, if the Court thinks you were 15% to blame it will order the other party to pay 85% of the figure it had previously assessed.
